1. Acceptance of Terms

By accessing and using the services provided by Greenspace Aerial Imaging ("Company," "we," "us," or "our"), you ("Client," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Services Description

Greenspace Aerial Imaging provides drone-based aerial imaging services including but not limited to:

  • Multispectral imaging for plant health analysis

  • Thermal imaging for irrigation coverage assessment

  • 3D modeling and mapping services

  • Related consulting and analysis services

3. Accuracy Disclaimer

IMPORTANT: All maps, models, and images produced by Greenspace Aerial Imaging are NOT survey-accurate and are NOT advertised or represented to be survey-accurate. Our deliverables are intended for analysis, visualization, and general planning purposes only. They should not be used for:

  • Legal boundary determinations

  • Engineering or construction planning requiring precise measurements

  • Any application requiring certified survey accuracy

  • Official regulatory submissions

For survey-accurate measurements, clients must engage a licensed surveyor.

4. Intellectual Property and Ownership

4.1 Ownership Rights

Greenspace Aerial Imaging retains full ownership and intellectual property rights to all maps, models, images, data, and deliverables created during the performance of services, unless otherwise negotiated in a separate written agreement.

4.2 Marketing Usage Rights

Greenspace Aerial Imaging reserves the right to use all maps, models, and images produced for marketing, promotional, and portfolio purposes, including but not limited to:

  • Website galleries and case studies

  • Social media content

  • Marketing materials and presentations

  • Professional portfolios and demonstrations

This marketing usage right may be modified only through separate written negotiation.

4.3 Client Usage License

Upon full payment, clients receive a non-exclusive, non-transferable license to use the deliverables for their internal business operations related to the specific golf course or property for which services were performed. This license includes the right to use deliverables for marketing, social media, advertising, promotional materials, and other business promotion activities related to the client's golf course or property.

5. Payment Terms

  • Payment terms will be specified in individual service agreements

  • Services may be suspended for overdue accounts

  • Ownership and usage rights are contingent upon full payment

6. Limitations and Weather Dependencies

Services are subject to:

  • Weather conditions suitable for safe drone operations

  • Regulatory flight restrictions and airspace limitations

  • Equipment availability and technical constraints

  • Client site access and cooperation

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our liability is limited to the amount paid for services

  • We are not liable for indirect, consequential, or punitive damages

  • We make no warranties regarding the suitability of deliverables for any specific purpose beyond general analysis and visualization

8. Indemnification

Client agrees to indemnify and hold harmless Greenspace Aerial Imaging from any claims, damages, or expenses arising from:

  • Client's use of deliverables beyond the scope of services

  • Reliance on deliverables for survey-accurate applications

  • Any misrepresentation of the accuracy or capabilities of our deliverables

9. Privacy and Data Protection

We respect client privacy and will not share specific operational data with third parties without consent, except as required by law or as specified in the marketing usage rights section above.

10. Modifications to Terms

Greenspace Aerial Imaging reserves the right to modify these Terms at any time. Updated Terms will be posted on our website with the revision date. Continued use of services constitutes acceptance of modified Terms.

11. Governing Law

These Terms are governed by the laws of Arizona without regard to conflict of law principles.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
